Iowa’s Hemp Legislation Debate: Balancing Sick Children’s Access to CBD Products

During a legislative session on Wednesday, Iowa, United States business operators and agricultural producers voiced their concerns over a proposed bill that could potentially disrupt local enterprises and limit access to cannabidiol (CBD) products for families seeking relief for their children’s severe ailments.

The focal point of the debate, House Study Bill 665, follows the restricted endorsement of medical cannabis in 2017 and the subsequent approval for the sale of certain hemp items in 2019. Since these legislative actions, Iowa has witnessed the growth of a market for cannabis and hemp products used for medical and leisure purposes, within the confines of the state’s 0.3% limit for THC (Tetrahydrocannabinol), the component responsible for cannabis’s psychoactive effects.

Proposed by the Iowa Department of Public Safety, the legislation aims to grant the Department of Health and Human Services greater authority in overseeing the distribution of hemp-derived and cannabis products. This includes the power to sanction businesses that defy state regulations, such as selling items exceeding the state’s THC threshold or products in prohibited forms like raw flower.

Additionally, the bill seeks to ban the distribution of cannabis products to individuals under 21 and enables the state to pursue administrative measures against vendors of alcoholic drinks infused with THC.

Scott Booher, representing Four Wind Farms, highlighted the bill’s potential to inadvertently penalize compliant businesses under its broad regulations. He specifically mentioned the bill’s restriction on minors’ access to hemp products devoid of THC, noting that some parents purchase CBD products to assist with their children’s behavioral issues and pain management.
